Paid subscriptions are billed monthly or annually in advance, depending on your selected plan. Subscriptions automatically renew unless cancelled before the renewal date. You agree to pay all charges associated with your account.

You may upgrade or downgrade your subscription plan at any time. Changes take effect at the next billing cycle unless otherwise specified. We reserve the right to change our pricing with 30 days' notice.

Payment Processing

Payments for certain products or subscriptions may be processed by Paddle. Paddle may act as the Merchant of Record/reseller for these transactions and may handle payment processing, applicable taxes, invoices, refunds, and billing-related customer support. When Paddle processes your payment, you will also be subject to Paddle's terms of service and privacy policy.

6. Customer Access After Payment

Upon successful payment processing, you will receive immediate access to your subscribed services and features. API access is activated automatically, and you can begin using the services according to your plan limits. In case of payment processing delays, access may be temporarily restricted until payment is confirmed.

7. Refund and Cancellation Policy

7.1 Subscription Cancellation

You may cancel your subscription at any time through your account dashboard or by contacting our support team. Cancellations take effect at the end of your current billing period, and you will retain access to paid features until that time.

7.2 Refund Eligibility

Refunds are generally not provided for consumed API usage or partial subscription periods, except:

We may perform scheduled maintenance that temporarily affects service availability. We will provide advance notice when possible and minimize disruption to your operations.

We provide support through email and our dashboard system. Support response times vary based on your subscription plan and the nature of your inquiry.

CRITICAL SAFETY NOTICE: All routing and weather outputs from our Services are decision-support tools only and are NOT a replacement for the professional judgment of the master, operator, or crew. Our Services should supplement, never replace, proper seamanship, official navigation resources, regulatory compliance, and established maritime safety procedures. The master and crew retain full responsibility for all navigation decisions and vessel safety.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLUE GREEN INTELLIGENCE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES, REGARDLESS OF THE THEORY OF LIABILITY.

Our total liability to you for all claims arising out of or relating to these Terms or the Services shall not exceed the amount you paid us in the twelve months preceding the claim.

11. Intellectual Property Ownership

The Services, including all software, APIs, data, and content, are owned by Blue Green Intelligence and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Services according to these Terms.

You retain ownership of any applications or content you create using our APIs. However, you grant us the right to use aggregated, anonymized data for service improvement purposes.

12. Data Usage and Analytics

We may collect and analyze usage data to improve our Services, including API usage patterns, performance metrics, and user behavior. This data will be used in accordance with our Privacy Policy and may be aggregated and anonymized for business intelligence purposes.

13. Termination and Suspension

You may terminate your account at any time by contacting us or using the account deletion features in your dashboard.

We may terminate or suspend your account immediately if you violate these Terms, engage in prohibited activities, or for any other reason with or without notice.
